Kevin F. Mickits

Kevin F. Mickits was born in Toledo, Ohio but was raised in Woodway, Texas, graduating from Midway High School in 1981. He attended Southwest Texas State (now Texas State) on a football scholarship. He played tight-end for Coach Jim Wacker and was a member of two, Division II National Championship teams. He was voted Captain by his team his Senior Year and was selected All Conference both athletically and academically during the same year. Kevin received a Bachelor of Science Degree in Education with specializations in Political Science and History. While finishing his studies, he married his wife, Julie, of Hillsboro Texas. They have three children.

Kevin taught in the public education system for three years before deciding not to return to academics in order to pursue a law degree at Texas Tech School of Law. During his tenure at Texas Tech, he was a two time member of the National Mock Trial Team and the recipient of the first ever J. Hadley Edgar Trial Advocacy Award. This award was presented to the top trial advocate at Texas Tech School of Law.

Since 1991 Kevin has tried over 100 cases to verdict in a variety of causes of actions including negligence, product liability, prescription errors, premises liability, premises security, defamation, deceptive trade practices, breach of contract, auto and trucking liability and consumer cases. The facts of each case are different, but his general approach is the same: know your case better than your opponent and determine how the case will be presented to the jury so that it is logical, simple and above all, factually honest.

After 20 years of active litigation, Kevin decided to expand his practice in order to utilize his experience to assist others in resolving legal conflicts. He has completed the State requirements necessary to become certified in mediation and arbitration. Having participated in hundreds of mediations as a litigator, Kevin looks forward to the special challenges associated with conflict resolution as an independent intermediary.

Mediation

I have made a living as a litigator. I was trained to complete discovery and prepare the case for trial. I still enjoy the challenges of litigation and the excitement of trial. However, over the past 20 years trial practice has changed. When I started my practice in 1991, mediation was in its infancy in South Texas. Today, mediation is commonplace in all areas of litigation. I have represented plaintiffs and defendants in litigation throughout the State of Texas . After many years of practice, I realized that while some cases still need to be taken to trial, often times, clients may be better served through the mediation process. As an attorney, and specifically as a litigator, I am failing my client if I do not present all possible options for their consideration and evaluation. Settlement and the compromise of litigation has historic and significant roots in our American legal system. I was introduced to a quote by Abraham Lincoln during my first year of practice and it has remained with me through the years.

“Discourage litigation. Persuade your neighbors to compromise whenever you can. As a peacemaker the lawyer has superior opportunity of being a good man. There will still be business enough.”
Lincoln tried his share of cases as a traveling lawyer in Illinois and in fact was notorious for his skill and wit in the courtroom. Nevertheless, he also recognized the value of a good settlement. It is with this spirit that I intend to approach mediation and it is my hope to serve as an honest, impartial and honorable intermediary for those involved in legal disputes.
